About this policy
Wiseman Accountants Pty Ltd (ABN 14 601 654 442) respects your privacy. This policy explains what personal information we collect, why we collect it, how we handle it, and what you can do if you want to see it, correct it or complain about how we have treated it. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
We are a registered tax agent, so we also have separate confidentiality obligations to our clients under the Tax Agent Services Act 2009, the Tax Practitioners Board Code of Professional Conduct and the APES 110 Code of Ethics. Those obligations sit alongside this policy.
This policy covers our website and the information we collect through it, as well as the information we hold about our clients. A short collection notice appears alongside our website forms, and our engagement terms set out how we handle client information in the course of the work we do.
What we collect
Through our website we collect the details you give us when you make an enquiry, complete our questionnaire or request a call. That includes your name, your business name, your phone number, your email address, your Australian Business Number and your website address, together with information about your business such as its turnover range, its structure, how many people it employs, the accounting software it uses, the state of its lodgements with the Australian Taxation Office, and anything you choose to tell us in your own words about what you need.
If you become a client we collect the information we need to do the work, which will usually include financial records, tax information and details about the individuals connected with your business, such as directors, trustees, beneficiaries, partners and employees. Some of this is information about people other than you, and we rely on you having the authority to give it to us.
We do not ask for your tax file number, your director identification number, your passwords or your bank details through our website, and we ask that you do not include them in a website enquiry. Where we need that information as part of the work, we collect it through our secure client systems rather than through the website.
How we collect it
Most of the personal information we hold comes directly from you, through our website forms, by email, by telephone, in meetings, or through the secure systems we use to exchange documents with you. We may also receive information about you from the Australian Taxation Office, from other government agencies, from your previous accountant or adviser where you have authorised the transfer, and from publicly available registers such as those maintained by the Australian Securities and Investments Commission and the Australian Business Register.
Cookies and analytics
Our website uses Google Tag Manager and Google Analytics. These record how the site is used, including the pages visited, how long is spent on them, the approximate location the visit came from, and the type of device and browser used. They set cookies in your browser to do this. We use the information to understand how people find and use the site and to improve it. We do not use it to identify you personally, and we do not currently run advertising or retargeting tools on the site. If that changes we will update this policy.
You can control cookies through your browser settings, though some parts of the site may not work as well if you block them.
Why we collect it, and how we use it
We collect and use personal information to respond to your enquiry, to work out whether we are the right firm for what you need, to provide our accounting, tax, superannuation, advisory and related services, to communicate with you and manage our relationship with you, to invoice you and collect payment, to meet our own legal, regulatory and professional obligations, including our obligations as a registered tax agent, to maintain and improve our systems and our website, and, if you have asked us to, to send you updates about tax and business matters.
We also keep enquiries on file where we may not be able to help you now but may be able to later, and we may contact you about that if your circumstances change. You can ask us not to at any time.
We will only use or disclose your personal information for the purposes described here, for a related purpose you would reasonably expect, where you have consented, or where the law permits or requires it.
Our website questionnaire
Our website questionnaire uses an automated process to sort enquiries according to the answers given. Depending on those answers it may offer you a time in our calendar, tell you that we will come back to you once we have looked at your enquiry, or explain that we are not the right firm for you at present and set out the other options open to you. That result is produced automatically and is shown to you straight away.
It is not a final decision about whether we can act for you. A member of our team reads every enquiry that comes through, and we may contact you even where the questionnaire has indicated we are not a fit. If you would like us to look at your enquiry again, please contact us.
Who we disclose it to
We disclose personal information to our own people and contractors, including a team member located outside Australia, so far as they need it to do their work. We disclose it to the third parties who provide the systems we run the practice on, which include our practice management, accounting, document storage, email, website, form and scheduling systems. We disclose it to the Australian Taxation Office, the Tax Practitioners Board, the Australian Securities and Investments Commission, the Queensland Building and Construction Commission and other regulators and agencies where that is part of the work we are doing for you or where we are required to. Where relevant to your affairs and with your agreement, we may disclose information to your other advisers, such as your solicitor, your financial planner, your lender or an auditor.
We do not sell personal information, and we do not disclose it for anyone else’s marketing.
Information sent or accessed overseas
Our website, and the enquiries submitted through it, are hosted in Australia.
Some of the other systems we use store information outside Australia, including our scheduling and analytics systems. One member of our team works outside Australia and accesses our Australian systems from there rather than holding information on her own systems. This means personal information may be accessed from, or stored in, countries other than Australia. The countries in which recipients are likely to be located are the United States and India.
Before we disclose personal information overseas we take reasonable steps to satisfy ourselves that the recipient will handle it consistently with the Australian Privacy Principles, including through the contractual terms we agree with our suppliers and the confidentiality obligations we impose on our people.
How we keep it secure
We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. Those steps include restricting access to the people who need it, using access controls and multi-factor authentication on our systems, keeping information in reputable business systems rather than on personal devices, and requiring everyone who works for us to keep client information confidential. No system is completely secure, and if a data breach happens that is likely to cause serious harm we will notify the people affected and the Office of the Australian Information Commissioner as the law requires.
How long we keep it
We keep personal information for as long as we need it for the purposes described in this policy, and for as long as we are required to keep it under tax, corporations, superannuation and professional record keeping obligations, which in some cases is many years after the work is finished.
Enquiries submitted through our website are stored on the website itself for 90 days and are then deleted automatically. We also receive a copy by email, which we keep in our own systems. Where you have made an enquiry and we have not gone on to act for you, we keep that record so that we can come back to you if we are able to help you later or if your circumstances change. We review those records from time to time and remove anything we no longer have a genuine reason to keep. If you would rather we did not keep your enquiry, tell us and we will remove it.
When we no longer need information and are no longer required to keep it, we take reasonable steps to destroy it or to remove anything that identifies an individual.
Updates and marketing
We will only add you to our mailing list if you have asked us to, or if you are a client and the material is relevant to the services we provide you. Every message we send identifies us and includes a way to unsubscribe. You can opt out at any time by using the unsubscribe link in any message or by contacting us, and we will action your request promptly. Opting out of updates does not affect the communications we need to send you about your own work.
Access and correction
You can ask us for the personal information we hold about you, and you can ask us to correct it if you think it is wrong, out of date, incomplete or misleading. Contact our Privacy Officer using the details below. We will respond within a reasonable time. There are limited situations in which we may not be able to give you access or make a correction, and if that happens we will tell you why in writing.
Complaints
If you think we have breached the Australian Privacy Principles, please tell our Privacy Officer, in writing if you can. We will acknowledge your complaint, look into it, and give you a written response within a reasonable time. If you are not satisfied with how we have dealt with it, you can take the matter to the Office of the Australian Information Commissioner at oaic.gov.au.
If your complaint is about our conduct as a registered tax agent rather than about privacy, you can also raise it with the Tax Practitioners Board.
